TURBOCARDS — End User License Agreement (EULA) — Android

Please read this agreement before installing the game. By installing or using TURBOCARDS you accept the terms below. If you do not accept them, do not install the game, or uninstall it.

1. Parties and subject

This agreement is between you and STARXEN — a company registered in the Polish Central Register and Information on Economic Activity (CEIDG), tax ID (NIP) 8542455132 ("we") — and covers the game TURBOCARDS for Android devices, downloaded from Google Play, together with its documentation and updates (the "Game").

2. License

We grant you a non-exclusive, personal license to install and use the Game for private, non-commercial purposes on Android devices that you own or use, to the extent permitted by Google Play.

3. Google Play

Downloading the Game, any payments, refunds and delivery of updates are handled by Google Play and are governed by the Google Play Terms of Service: https://play.google.com/about/play-terms/. Google is not a party to this agreement and is not responsible for the Game.

4. Restrictions

Without our permission you may not:

  • distribute, rent or sell copies of the Game,
  • use it for commercial purposes,
  • remove copyright notices,
  • decompile or modify the Game except to the extent expressly permitted by law.

5. Copyright and trademarks

The Game is protected by copyright and owned by STARXEN. You acquire a license to use it, not rights in the Game. The TURBOCARDS and STARXEN names and logos are our marks and may not be used without our permission. Third-party components (including the Godot engine — MIT License, fonts — SIL Open Font License) are subject to their own licenses. They are listed in the Game on the "About" screen. Android and Google Play are trademarks of Google LLC.

6. Online features and privacy

The Game works fully offline and does not send any data by itself. In future versions we may add optional online features (e.g. a Daily Challenge downloaded from a server or submitting played deals for verification). They will be off by default: you turn them on yourself in the Game, and before you do, the Game will show what data they send. The Game works fully without them. Details: TURBOCARDS Privacy Policy — in the Game (on first launch and on the "About" screen) and at turbocards.net.

Online features, if added, are an extra: we do not guarantee their continuous availability and may change, suspend or discontinue them. The Game then remains playable offline. You may not interfere with or overload our servers or submit falsified results. We may reject such submissions.

7. Updates and changes to this agreement

We may release updates that change or improve the Game, including adding the optional features described in section 6. Updates are delivered through Google Play.

We may change this agreement for valid reasons: changes in law, security, new or changed features of the Game, or clarifying its terms. We will publish the new version in the Game and at turbocards.net, with a new version date. A change that does not make your position worse applies from publication. A change to your disadvantage requires your consent — if you do not give it, you may keep using the Game under the previous terms, without the features the change concerns.

8. Warranty and liability

We provide the Game as it is. To the extent permitted by law, we do not guarantee that it will run without errors or interruptions on every device. We are also not liable for indirect damages related to using the Game, such as loss of data or lost profits.

These limitations do not affect the rights you have as a consumer under the law, in particular your rights if the Game does not conform to the contract. Nor do they exclude our liability for damage caused intentionally.

Quality matters a great deal to STARXEN. Please report any technical problem by e-mail to [email protected]. We will make every effort to resolve each reported problem.

9. Termination

This agreement remains in effect until terminated. You may end it at any time by uninstalling the Game. It ends if you breach its terms. You must then stop using the Game and uninstall it.

10. Governing law

This agreement is governed by Polish law. If you are a consumer, this does not deprive you of the protection of the mandatory provisions of the law of your country of residence.

11. Final provisions

This agreement (together with the Google Play Terms of Service as regards downloading and payments) is the entire agreement regarding the Game. If any provision is found invalid, the remaining provisions stay in effect, and the invalid one is replaced by a lawful provision closest to its purpose. Our failure to exercise a right in a given situation is not a waiver of that right.
