TURBOCARDS — End User License Agreement (EULA) — iOS and iPadOS

Please read this agreement before installing the game. By installing or using TURBOCARDS you accept the terms below. If you do not accept them, do not install the game, or delete it.

1. Parties and subject

This agreement is between you and STARXEN — a company registered in the Polish Central Register and Information on Economic Activity (CEIDG), tax ID (NIP) 8542455132 ("we") — and covers the game TURBOCARDS for iPhone and iPad, downloaded from the App Store, together with its documentation and updates (the "Game").

2. License

We grant you a non-exclusive, personal, non-transferable license to use the Game for private, non-commercial purposes on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the App Store Terms of Service. The Game may also be used by other accounts associated with your account via Family Sharing or volume purchasing.

3. App Store and Apple

  • This agreement is concluded between you and us only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the Game and its content.
  • We are solely responsible for providing maintenance and support for the Game, as specified in this agreement and under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Game.
  • In the event of any failure of the Game to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Game (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Game. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our responsibility, to the extent not excluded by this agreement.
  • We, not Apple, are responsible for addressing any claims by you or any third party relating to the Game or your possession and/or use of it, including product liability claims, any claim that the Game fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
  • In the event of any third-party claim that the Game or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such claim.
  • You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • You must comply with applicable third-party terms of agreement when using the Game (e.g. your wireless data service agreement).
  • Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and upon your acceptance of it, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary.

Downloading the Game, any payments, refunds and delivery of updates are governed by the App Store Terms of Service: https://www.apple.com/legal/internet-services/itunes/.

4. Restrictions

Without our permission you may not:

  • distribute, rent or sell copies of the Game,
  • use it for commercial purposes,
  • remove copyright notices,
  • decompile or modify the Game except to the extent expressly permitted by law.

5. Copyright and trademarks

The Game is protected by copyright and owned by STARXEN. You acquire a license to use it, not rights in the Game. The TURBOCARDS and STARXEN names and logos are our marks and may not be used without our permission. Third-party components (including the Godot engine — MIT License, fonts — SIL Open Font License) are subject to their own licenses. They are listed in the Game on the "About" screen. Apple, iPhone, iPad and App Store are trademarks of Apple Inc.

6. Online features and privacy

The Game works fully offline and does not send any data by itself. In future versions we may add optional online features (e.g. a Daily Challenge downloaded from a server or submitting played deals for verification). They will be off by default: you turn them on yourself in the Game, and before you do, the Game will show what data they send. The Game works fully without them. Details: TURBOCARDS Privacy Policy — in the Game (on first launch and on the "About" screen) and at turbocards.net.

Online features, if added, are an extra: we do not guarantee their continuous availability and may change, suspend or discontinue them. The Game then remains playable offline. You may not interfere with or overload our servers or submit falsified results. We may reject such submissions.

7. Updates and changes to this agreement

We may release updates that change or improve the Game, including adding the optional features described in section 6. Updates are delivered through the App Store.

We may change this agreement for valid reasons: changes in law, security, new or changed features of the Game, or clarifying its terms. We will publish the new version in the Game and at turbocards.net, with a new version date. A change that does not make your position worse applies from publication. A change to your disadvantage requires your consent — if you do not give it, you may keep using the Game under the previous terms, without the features the change concerns.

8. Warranty and liability

We provide the Game as it is. To the extent permitted by law, we do not guarantee that it will run without errors or interruptions on every device. We are also not liable for indirect damages related to using the Game, such as loss of data or lost profits.

These limitations do not affect the rights you have as a consumer under the law, in particular your rights if the Game does not conform to the contract. Nor do they exclude our liability for damage caused intentionally. Your rights in relation to Apple are described in section 3.

Quality matters a great deal to STARXEN. Please report any technical problem by e-mail to [email protected]. We will make every effort to resolve each reported problem.

9. Termination

This agreement remains in effect until terminated. You may end it at any time by deleting the Game from your devices. It ends if you breach its terms. You must then stop using the Game and delete it.

10. Governing law

This agreement is governed by Polish law. If you are a consumer, this does not deprive you of the protection of the mandatory provisions of the law of your country of residence.

11. Final provisions

This agreement (together with the App Store Terms of Service as regards downloading, payments and the Usage Rules) is the entire agreement regarding the Game. If any provision is found invalid, the remaining provisions stay in effect, and the invalid one is replaced by a lawful provision closest to its purpose. Our failure to exercise a right in a given situation is not a waiver of that right.
